Our range of fixed price construction contracts (“FPCC/s”) gives our developer, contractor and sub-contractor clients access to the ability to contract with certainty and on their chosen terms.

In our experience, one of the most frequent causes of disputes on construction projects is uncertainty as to contract terms. The FPCCs are but one example of our philosophy that prevention is better than cure. The avoidance of a dispute is far more satisfactory and efficient – both in terms of cost and time – from a client’s perspective than its successful resolution. Using our FPCCs as intended will create certainty and enable our clients to choose the terms on which they contract with suppliers. You can rest assured the FPCCs reflect updates in the law and are tailored to your industry needs.

Each FPCC comes with Guidance Notes on how to use it.

The FPCCs have been selected because they are in our experience those which are most likely to be the subject of uncertainty and lead to disputes. Recognising the reality of how most construction projects are procured we anticipate and recommend the use of standard form main contracts where appropriate. Our team members are available, where required, to advise on the appropriate main contract terms and to review and/or draft amendments to them, where appropriate. Our team can also advise on how our FPCCs interact with standard form main contracts.

Are fixed price contracts right for you?

Each FPCC comes with a Guidance Note containing the information necessary to complete the project specific details and ensure that the terms become part of the contract. Our contracts will equip you to contract safely and with certainty.

Why fixed price contracts make sense

The philosophy behind the FPCCs is to make our legal knowledge and experience accessible to clients at a competitive price. Once purchased they can be used as many times as required.

The cost

The options for accessing FPCCs are as follows:

  • Permanent access to one individual contract – £250 plus VAT per contract
  • Permanent access to all contracts – £400 plus VAT
  • Subscription: permanent access to all contracts plus updates; and unlimited use of our renowned Netchaser* debt recovery service – £500 plus VAT and £200 plus VAT per annum after one year.
